Request to the Scientific Council

Honourable Members of the Scientific Council,

With respects to the current standing Laws of the Confederation and the professional & legal views of the current standing members of the Scientific Council, is it legal for a sub-ordinate official of the Chancellor to stand and be elected as a Representative in the Representative Assembly of this Confederation?

The finding of the SC is that a person whose duties do not include administrative control, or executive or judicial power may serve on the RA while performing those other CDS duties--in this case Assistant PIO. There are prohibitions against serving on the RA while being on the SC or holding the offices of Chancellor or Treasurer (Treasurer Act,http://portal.slcds.info/index.php?id=181). The RA passed a Resolution that serving on the RA while holding the position of Caretaker for the CDS would be permitted. The position of Content Archivist has also been held by someone who is also held elected or administrative office. It is also recommended that the 14th RA consider enacting a Law regarding Conflict of Interest and service concurrently in elected and appointed positions not covered currently in CDS law.
