Citizens.

The Confederation of Democratic Sims, Land-Use Commission has completed its first session, an internal administration meeting.

You now have the following members as your new, LUC servants:

Josie Cooperstone -- Vice Chair; New-Sim Committee, Chair
Leslie Allandale -- Chair; Law-Review Committee, Chair; Scope-of-Authority Committee Chair.
Rosie Gray -- Inspection-Procedures Committee Chair; General-Plan Committee Chair.
Tor Karlsvalt -- Time-line/Calendar Committee, Chair.
Shep -- Chancellor-Liaison Committee, Chair.

TRANSCRIPT OF THE 1ST LAND-USE COMMISSION MEETING HELD ON SATURDAY, NOVEMBER 15TH

[08:07] Tor Karlsvalt: Welcome to the first meeting of the Land Use Commission.
[08:08] Tor Karlsvalt: I have been asked to be the first chair at this meeting. But we will be electing the actual Chair in a moment..
[08:08] Rosie Gray: btw I IM'd anti to say we are starting (no idea if she receives IM's offline)
[08:09] Leslie Allandale: then we can appoint her to head the most unwanted sub-committee
[08:09] Tor Karlsvalt: We will be using the column in front (short and black column) as does the RA to oder the speakers.
[08:10] Tor Karlsvalt: The agenda is in the box with the CDS flag on it. It is located in front of the commissioners.
[08:11] Leslie Allandale: Shall we adopt the agenda?
[08:11] Tor Karlsvalt: Shep will participate as a commissioner. Shep has been appointed by the Chancellor but has not been confirmed by the RA.
[08:12] Tor Karlsvalt: She will not have a binding vote at this time.

[08:34] Josie Cooperstone (josephine.fotherington): Is there any established precedent for length of commissioner terms? On any commission?
[08:35] Leslie Allandale: Not that I know of
[08:35] Rosie Gray: we don't have any standing commissions like that
[08:35] Tor Karlsvalt: no, I don't think we ever had any standing commissions.
[08:35] Leslie Allandale: The bill was written to provide staggered terms for coherence.
[08:35] Rosie Gray: so we'll be setting a precedent
[08:35] Tor Karlsvalt: um, what Rosie said.
[08:36] Josie Cooperstone (josephine.fotherington): ok - just checking to see if there is a "rule of thumb", but if we're the first then I understand.
[08:36] Leslie Allandale: I wanted to provide independence with accountability.
[08:36] Rosie Gray: the only question I have, would be re the #4 point
[08:36] Leslie Allandale: and a broad spectrum of interests represented.
[08:37] Leslie Allandale: What would you suggest Rosie?
[08:37] Rosie Gray: would we start with one person being 6 months so there is a stagger?
[08:37] Leslie Allandale: Yes

[08:39] Leslie Allandale: 1. Members terms shall last, at the pleasure of the CDS Representative Assembly, until replaced by a new member, confirmed by the assembly.
2. The RA shall nominate its member at the beginning of its term.
3. The Chancellor's Office shall nominate its representatives at the beginning its term.
4 The Guild and RA shall each nominate one of its citizen-members at the mid-point of its session to replace its member whose 12 month term is expiring.. The first appointments shall be for two, each, one for 6 months, the other for 12.
[08:39] Josie Cooperstone (josephine.fotherington): Question: should we add a line for resignation procedure?
[08:39] Leslie Allandale: Does that work?
[08:40] Leslie Allandale: I believe that procedure is already spelled out in the law
[08:40] Josie Cooperstone (josephine.fotherington): Since there were so many resignations this last year in CDS? :-)
[08:40] Rosie Gray: I think it works since we all know what it means (but if I didn't already know, I'd be confused)
[08:41] Leslie Allandale: We can send this to the RA, and they can rewrite to their needs?
[08:41] Josie Cooperstone (josephine.fotherington): Ok - so there is a general procedure for resigning from any CDS post?
[08:41] Rosie Gray: no there isn't
[08:42] Tor Karlsvalt: There is for RA and the Chancellor.
[08:42] Rosie Gray: they are specific
[08:42] Leslie Allandale: . A member may resign or be removed from office at the discretion of the RA upon the recommendation of their nominator. This resulting vacancy, or the vacancies due to end-of-term, shall be filled according to the legislated process, the new member(s) assuming the term of the member(s) replaced.

[08:42] Rosie Gray: that's for RA members
[08:42] Leslie Allandale: this is for LUC members
[08:42] Josie Cooperstone (josephine.fotherington): So we go with the assumption of "if an LUC commissioner resigns, the body that elected that commissioner replaces her/him"?

[08:42] Rosie Gray: that would make sense to me

[08:54] Tor Karlsvalt: I was wondering that if we are to hear concerns regarding builds by citizens perhaps we should have at least a regular meeting frequently for such items.

[08:55] Leslie Allandale: It would be good if we could have at least one a month that all citizens could plan on.l

[08:55] Rosie Gray: doesn't have to be all of us meeting all the time for that

[08:56] Leslie Allandale: We could appoint an inspector to do private approvals.

[08:56] Josie Cooperstone (josephine.fotherington): And people in SL are impatient. They'll leave if they have to wait too long for approval.

[08:57] Rosie Gray: many times it will be a 'rubber stamp', but of course not always
[08:58] Rosie Gray: so for the 'rubber stamp' times, we could start off with say 2 of the commissioners inspecting, and if there is no problem, we rubber stamp
[08:58] Rosie Gray: if there is a problem, then move to the next procedure

[08:58] Rosie Gray: it could be something as easy as the 2 commissioners making requests to the citizen to modify their build, and then have a reinspection

[08:59] Tor Karlsvalt: oh ok, I see what you mean, then we would hear appeals of the inspectors' decisions.

[08:59] Rosie Gray: say someone put down a fantasy castle where it's supposed to be a mountain chalet style, for instance

[09:00] Josie Cooperstone (josephine.fotherington): Could we handle the next level in asynchronous online communication (like a private group in the forums) with a time limit on discussion?

[09:00] Josie Cooperstone (josephine.fotherington): For example, 2 commissioners inspect, they don't agree or the citizen appeals

[09:01] Tor Karlsvalt: That sounds like a good plan.
[09:01] Josie Cooperstone (josephine.fotherington): Which is all 5 of us discussing it online (in some way) with like a 5 days limit on debating/conversation?

[09:01] Tor Karlsvalt: But we still would have to have some schedule for these hearings or meetings.

[09:02] Leslie Allandale: Can we get a motion for Rosie to write the protocol -- with input, of course.

[09:02] Rosie Gray: so that we aren't airing people's laundry in public

[09:02] Tor Karlsvalt: yeah, at times people get sensitive about this.
[09:03] Josie Cooperstone (josephine.fotherington): My biggest concerns are keeping it private and keep it expeditious.

[09:03] Josie Cooperstone (josephine.fotherington): So we all have a way to discuss it, but we have a clear "end of discussion" and then provide an answer.
[09:04] Tor Karlsvalt: I think a public hearing might be final resort if the person is unhappy with the decision.
[09:04] Josie Cooperstone (josephine.fotherington): As for public hearing (that Tor mentioned),

[09:05] Shep (shep.titian): I would'nt want a public hearing on my home
[09:05] Rosie Gray: I agree, I think that the public hearing would only be a last resort though
[09:05] Leslie Allandale: Public hearing is only if owner takes it that far.
[09:05] Shep (shep.titian): by that point I would feel so unwelcome I would leave
[09:05] Rosie Gray: if someone is just plain refusing to comply

[09:06] Tor Karlsvalt: I think we have a lot of good issues raised here, so I motion that Rosie, with input from other members, write a proposal on how to proceed with build inspections and Commission oversight.

[09:07] Leslie Allandale: SECTION VII: RECOURSE
Decisions made by the Commission and/or its inspectors, plus any subsequent action(s) by the Chancellor’s Office may be challenged: a. By a petition of the affected party; b. In a format approved by the commission, including a requirement of personal attendance; c. To the Land-Use Commission; d. At its next scheduled meeting, or sooner, if a quorum of the Commission agrees to expedite the process. The decision of the Commission shall be binding on all parties, subject to appropriate appeals.

If a conflict arises between existing laws and the duties, responsibilities and authorities specified in this law, this law shall prevail. Existing covenants, codes and procedures which fall under the purview of this bill but are not explicitly described in it, shall continue according to present use until the Commission shall recommend new codes and procedures to be subsequently approved by the Representative Assembly.
