Grant of Neufreistadt School to Guild Act

Preamble

The CDS Artisan Guild, chartered under the provision of the annexed document, is an independent, non-governmental organization (NGO) based in the community of the Confederation of Democratic Simulators (CDS), created to encourage and assist a high standard of excellence in the creative output of content of Second Life residents.

Since July 2012, under the provision of NL 4-16 'Public Prim Allotment Act', the CDS Artisan Guild, as allowed to any chartered organisation in the CDS, has been providing monthly fee payments for the Neufreistadt School, a Government-owned parcel with a public landmark situated in the inner city of Neufreistadt, according to its current size and prim allotment. Under the provision of this law, the CDS Artisan Guild is entitled to usage of that space in exclusivity, for the purposes established on their own charter, so long as the monthly fee payments are being duly paid, as it has been the case until now.

Due to the overall interest in maintaining the activities of the CDS Artisan Guild, and since they have been dutifully contributing to monthly fee payments without interruption over a period of two years, it is the considered opinion of the Representative Assembly that the Neufreistadt School shall be privatized and the ownership of the parcel and all the buildings conferred to the CDS Artisan Guild in perpetuity.

As such, the Representative Assembly decrees:

  1. The parcel identified for the Neufreistadt School shall be detached from public land and instead set to the private group for the CDS Artisan Guild (to be named by the current Guildmeister [Executive Director of the CDS Artisan Guild]). All buildings on the parcel shall also be set to the same group.

  2. From the moment that the parcel and its buildings are set to the group named by the CDS Artisan Guild, the parcel ceases to be public, Government-owned land, its ownership is conferred to the CDS Artisan Guild, and NL 4-16 will cease to apply.

  3. The Neufreistadt School is recognized under this act as being 'a CDS historical building under private ownership' and, as such, substantial change of the building's façade shall be subject to a Chancellor approval. Nevertheless, the desire expressed in NL 4-16 for prim reduction shall be encouraged, and any changes that reduce visual lag should be approved.

  4. The cost of the ownership transfer shall be one Linden dollar (L$1).

  5. The land including the Neufreistadt School shall be group-owned (and not owned by a single individual) as per NL 5-9 'Group Land Ownership Act' and NL 7-7 'Amendment to NL 5-9 Group Land Ownership Act' and any other legislation, existing or future, that applies to group ownership in the CDS.

  6. Ownership of the land where the Neufreistadt School is situated does not include the right of selling, transferring, donating, renting, leasing, sub-letting, or any similar land speculation activity.

  7. The CDS Artisan Guild is reminded to comply with its duties towards the CDS, namely in terms of monthly fee payments, compliance of covenants, and any other duties established under NL 5-9 and NL 7-7. Government claiming of the land in case of delinquency of the monthly fee payments shall follow the established procedures as for any other private land, but the land shall become Government-owned afterwards.

  8. In case that the building, or the parcel where it is situated, is used for any other purpose not listed in the CDS Artisan Guild's charter, the Government is entitled to reclaim the land.

  9. In case the CDS Artisan Guild is permanently dissolved or substantially changes its charter or form of organisation, the Government shall reclaim the land.

  10. At any moment, the CDS Artisan Guild is allowed to return ownership of the land and the building granted under this Act back to Government, when it once more will become public land.

  11. If the Neufreistadt School land is reverted to public land as a consequence of the above clauses, this Act shall be declared null and void, and henceforth the Neufreistadt School and its parcel will revert to its original status as public Government-owned land, again under the terms of NL 4-16 (as before). Other groups shall afterwards be allowed to use this space as under the provisions for the usage of any public land.

Just to let everybody know: I'm going to retract this proposal, and instead rewrite it, based on some feedback I got privately.

The changes will probably be more easier to understand and make this 'grant' less controversial, while achieving precisely the same purpose!
