Land Permissions and Banning

A few days ago, I was at my place in Colonia Nova. I was the only one in the sim so I noticed an avatar pop in on my mini-map about 50 meters away. It wasn't anyone I recognized and at first I didn't think anything of it until they started heading to my place. I didn't really want company - I was busy trying to solve a tricky coding problem - and was rather ruffled when I watched them advance on my mini map and then saw their overhead text through my wall as they headed up my stairs (meaning at this point they were on my property, not on the public road). So I logged out. No big deal at this point, just a minor annoyance.

Yesterday, again I was at my place, again working on fixing an issue with skirts (I make dresses), when I noticed the same avatar pop in on my mini-map about 50 meters away and it seemed to be heading my way again. This time, I had more advance warning so I opened his Profile and found they were into stalker and rape role-play. This is really truly absolutely something I'm not interested in. If you want to do it, that's fine, but don't involve me. About the time he was going to enter my property again, I dropped his name into my land menu ban list, whereupon he changed direction and started heading towards Kellie (who I saw on my land map) and IM'd her, asking if she knew him. She said no, but she recognized him as being an avatar that comes around CDS.

Here is why I am bringing this up. Last year, when I joined CDS, there were no restrictions that I knew of about people being able to ban others from their land; now I hear there are. Technically, I broke CDS law by banning this guy (or did I?). Do I have to wait to become a victim before I can take action to protect myself, and even then, what are my rights?

I'd like to have an open discussion about this, please.

Bagheera -

According to the executive order you need to report it to the Chancellor who will arrange for it to be removed.

If it were me, I would notify the Chancellor - PIO or anybody in the government to help - and if it wasn't on a path to resolution quickly, I'd likely feel tempted to take things into my own hands if I had the rights to remove prims from the land.

I might be mistaken, but I think that there has been a prohibition on banning at least as far back as 2006. The goal is to prevent the problem common on the mainland of having a landscape made ugly and impassable by banlines. The plan was to police specific acts of harassment by CDS-wide banning after a proper judicial process. The SC was empowered to engage in that activity and the code of procedure (which they are unfortunately ignoring) was instituted to provide for Due Process.

While I can understand the utility of banning (specifically, of targeted banning rather than creation of "invitation only" zones), the past history of this involved use of banning for political purposes and political harassment (I'm sure you are shocked by that), and the CDS community decided, at that time, that the most efficient fix was to prohibit banning.

I'd be happy to revisit this issue as a policy matter, but I do not want to see the CDS become a hodgepodge of banlines.

You can do what you like with your land, provided you work within the relevant covenant. Banning someone into rape role play (I assume not a citizen?) seems fine to me. Banning other citizens would be fine too, probably not very popular but you have the right to do so if it's your land.

I think you can ban individuals from your land. I don't think you can put up ban lines in general like you can on the mainland.

Pat and Bromo are probably right -- and the rule of allowing specific banning but not ban lines makes sense to me.

5. Ban lines are not permitted. Parcels must be set for public access on the access tab of About Land. As a land owner you are allowed to ban individual avatars from entering your land, but please do not ban all. Use courtesy and common sense.

I take this to mean you can ban individual persons but not the entire SL.

Bells,

I agree with your interpretation of the rule, on your pesonal property in CDS you can ban individual avatars whether or not they are CDS citizens. I hope I never has to ban an individual from my personal property but it is nice to know I have that option if necessary.
