Re: Trial Period

[quote="michelmanen":wj8hcael]Gxeremio,

This is the entire point of the Commission as currently proposed. The legal system start working, the Commission makes its assessment based on that and on public consultations and comparison with the Adjudication system, then all options are on the table - from total repreal to no change at all.

Is this not what you said previously you agreeed with and could support?[/quote:wj8hcael]

Yes. But unfortunately you seem to be the only proponent of the Judiciary Act who recognizes the legitimacy and wisdom of that path. For the others, the more we allow the plans to move forward, the more legitimate and necessary the system becomes in their minds. At least, that is my perspective from the posts of Patroklus and Ashcroft (who as far as I can tell are the only people who have posted in support of the system). I would be very happy to be wrong about this.

Justice will be done

Well, we don't agree on any of this. You can't assess something in theory and on paper; only when you see how it actually functions and all pieces come together can one pass an informed judgement. Believe me , I live in Canada, a country which is "totally impossible in theory, but works very well in practice".

The Act will not be repealed.

The Code will not be suspended.

Additional Judges will be appointeed.

Cases will be heard.

Justice will be done.

Why are you fighting this so much? What are you afraid of? Let us see where this takes us - then we can make an informed decision. In any case, there is nothing you personally can do to stop this right now.

Only the RA can.

And the RA, as presently constituted, will not reverse itself.

Deal with it!

Gxeremio,

I have no doubt both Pat adn Ash think along the same lines as I. It is only a matter of deciding how the Commision will operate, how long the trial period will be, and what changes (from total repeal to no change at all) will the Commission recommend.

I will make sure they post notices to this effect, so that you may clearly see they are entirely reasonable.

No one wants to ram down anyone's throats a legal system that is not effective, efficient, fair, and fast and that does not have the support and confidence of CDS citizens. All we want to do is test the sytem out, and playfairly and in accordance with the rule of law and the democratic rules of CDS.

I trust this is not such an unreasonable, excessive request...
